Hi,
My spouse (Indian citizen) has received an RFE for her derivative I485 application.
Her birth certificate has a different first name than her passport. We had filed the birth certificate and an affidavit from her parents attesting to the change. But that doesn't seem to be sufficient.
The RFE states:
"Your birth certificate indicates that your first name is XXX and not YYY. Please explain and submit additional documentation in support of your claim".
...
"Copies of the personal pages in your passport OR affidavits are not sufficient to establish a legal name change. Court documents submitted as evidence of name change must have been registered with the proper civil authority".
We now plan to submit the following:
1. Court Affidavit filed by my spouse's father at that time of legal name change, at age 3. This affidavit was before a Sessions Judge in India. This was the legal process of changing her name at that time.
Will this be sufficient? We don't understand what it means for a court document to be registered with the proper civil authority. Can you please advice?
2. My spouse has a Certificate of Age, Domicile and Nationality issued by the State Goverment of Maharashtra that refers to the new first name and also refers to the birth certificate as well, as proof.
Will that count as sufficient "registration with civil authority"?
I would appreciate if someone who has go through this issue would comment on the proper ways of addressing this.

Thank you so much for your response. Need a litle clarification on I-824. Can I file I-824 before my I-485 gets approved? If so, how can i request alternate chargeability to my spouse's country with out her I-485?
If not what is the best way to claim alterate chargeability to my Spouse country of birth. Gues I have to bring bring my family on H4 and submit I-485 in US or switch to consular processsing. Is there any other possible way other than these 2 procedures?

1. Which location i need to mentioned as primary ,home or where company located?
The LCA should list the job location as your home address.
2. Which state should the payroll runs where i live or where my seat is located?
It doesn't matter for immigration purposes.

Hi thanks a lot for the prompt reply. But I am curious to know the chances of getting my transfer petition approved from my current employer. I heard we should be in H1B status before apply for transfer and we should have minimum 3 paystubs from the employer who processed H1B.
So without having all these is there any chance to get my transfer petition approved?

My employer is moving office to new address.How will it effect my future GC process ?. Thanks in advance
If the company is moving within the same county then no issues.
If it's moving to a different state (or) to a different county within the same state, then refer the following thread

You should apply for a renewal EAD six months before your original EAD expires. Check out this link below.

here are the visa numbers used in 2006 for EB2 and EB3.
EB-2: India(3,720), China(3,347), Canada(1,248)
EB-3 Skilled: Mexico(6,766), Korea(4,375), Philippines(4,114), Ecuador(3,747), Brazil(3,670), Poland(3,230), India(3,006), China(2,477), Pakistan(2,091)
Assuming there are atleast 300K Indians waiting for visa numbers in the EB2 + EB3 category (including dependents) and 6726 out of them were covered last year, we will have to wait for just another 44 years and 7 months to get an immigrant visa number. LOL
If everything goes well as planned atleast GC is assured for our children ( for some like me - grand children) .

Friends,
I am currently working at a systems company based on my EAD (H1 has expired). PD is Jun 2006.
I intend to marry a woman who is currently on F1 visa. I would like to know if there are any pitfalls from immigration point of view.
I understand that she can get an EAD only when my PD becomes current.
Can she file her I-485 petition based on my approved I-140? If yes, would she continue in F1 status (or what will her status be?).
Any other potential pitfalls in this particular scenario?
Any pointers would be useful.

IF he transfers to a function that is significantly different than his approved labor certification he may have to restart his GC application by filing a new LC application. However, since GC is for future job and if his employer will agree for him to go back to his previous practice then he may continue with current GC process and change when 485 is approved.

My friend works as an internal auditor within a big 4 acccounting firm. His practice is doing quite badly. As there are tons of different practices within this firm, he is thinking about transferring. But his PERM was filed for the internal audit manager position and his I-140 has alreday been approved. If he transfers to a function unrelated to internal audit within his firm (e.g. external audit, tax, fraud, etc.), would there be a problem?
Can anyone here provide some guidance or point him to the right discussion thread?

Guru, I intend to seek your opinion/thoughts on some thing that is going on in mind.
I am working as a contractor for a Insurance Company. My GC process is started thru a desi consulting company. Priority date is Jun 2007 EB3 - India
The company is now offerring me to join them as permanent employee. They are saying they can help me with immigration.
My question is .. I dont understand how they can help me. I think the best they can do it apply as EB2 - India. (Which we heard recently is no better then my current EB3 India.)
Am I missing anything here ? Trying to make up my mind one way or the other (to accept this position or not.)

The image above is a very nice, serene capture. But the one that really stands out for me is the fern (below). First you saw the shot. Most wouldn't. Then you used good DoF, a good composition, and exposure control to capture the fern without blowing it out but give us enough of the shadow to keep the fern in context. Without the shadow detail, the fern would look out of place. Nice work.
Maybe you didn't get as many keepers as you wanted, but it sounds like you learned some things and you did get a couple of keepers so it was a profitable trip in my estimation. I think we've all been at that "wish I'd used my tripod" spot. It's really irritating if you own one and don't use it and flat out maddening if you take it along with you on a shoot and don't bother to use it. The part that makes you spit nails is there's only one person to blame. . . I'm betting that tripod gets a workout the next time you wander into the woods.

I have filed my H1B extension on November as my H1B is expiring on 23rd Feb.
I haven't got my approval yet. I have currently EAD and my I140 approved.
My question is if I don't get my approval on or before 23rd Feb what will happen to my status?
My Lawyer said once you filed you have 140 days (or 160 days forgot) for approval meaning even if it does not get approved on or before I will be on H1B till I complete 140 days from date of filling.
Please advise.

I filed my H1(8th year) ext on Oct 21st, 2007 and got my approval notice via mail directly to my employer on Jan 31st. Useless online status still shows "Case received and pending"...:D

I don't see a reason why premium processing will lead to rejection. Certainly that is not the case with H-1B. Infact 2-3 years back H-1B premium processing had 0.5% higher approval rate than regular H-1B.
