There is a quirk in the immigration laws that allows a person working for a cap-exempt employer to start working for a cap-subject employer once the petition is filed, even if the new H-1B status cannot start until 10/1/09. If the new employer files an LCA with a start date of 7/27, you should be able to work for that new employer under H-1B portability. However, if the new petition is denied, you lose your work authorization immediately.

My LC application (RIR PD Oct 2003) from company A is pending in P-BEC. My RIR got denied recently in Nov 06 and my company informed me that they are considering to use TR->RIR conversion to upgrade the LC to RIR. Can somebody please tell me the process of TR->RIR converion? How long it takes? Pros. and Cons. ?Any help is greatly appreciated

I can comment on second item. I was in the same situation (PD March 05 @ D-BEC). There was absolutely no communication from DOL. One fine day in Sept, I got case approval notice (via lawyer). I think there is still hope yours may be done soon.

Hello,
I entered this country (US) on a F1 visa. I've completed my masters and during my post-completion OPT I was offered a job by a company who filed my H1. It was approved in Nov 09 and was valid until Nov 2012. But in Apr 2010 I was laid off and since H1 doesn't have any grace period and I couldn't find an employer ready for a transfer, so I changed my status back to F1. I'm currently working for an IT consulting company (full time) at their client location. The client would like to hire me full time. But since I'm working on my CPT, and do not have a valid H1 visa is it possible that the Client can simply transfer my existing H1 or do they have to file a new H1 as my status has changed. Please suggest as I'm very Confused how to deal with this situation as I do not want to lose an opportunity. Also please do throw some light on any grey areas if present.

Take one month unpaid vacation. Packup your things. Send family home. Work for one or two weeks(stay in a motel or with friends), resign and go same day or next day.

You are still a legal permanent resident and can apply for a job proving your eligibility with your Social Security card and valid drivers license/state ID.
Get a new card by filling out form I-90 with USCIS and pay the required fees.

Some online news said about the proposed EB-6 visa (start-up visa bill) is to get $250,000 funding from US investor into your business and create 5 jobs or 1 Million dollars in profits within 2 years, then the entreprenur will be granted the US green card.
No profits will be guaranteed in any kind of business. Personally I do think this EB-6 visa is very very difficult to work because it is NOT easy to find someone to invest those big sum of money into your business during this great economic recession. So I am thinking about why don�t give out green cards to international students who have advanced degree in Science & Medicine regardless of whether those students have a US job offer or not. It is because immigration of those international students lead to the inflow of knowledge and money to US and it will indirectly increase the US reputation and uplift the US economy. I do believe the inflow of knowledge and money are keys for immigration which are welcomed by all other countries in this world. Since those international students are trained by US and they are familiar with the US surroundings, therefore, I do think the inflow of money for immigration should be brought back to US. Also, if US absorb those inflow of knowlegable groups for immigration, US will become more and more famous in the world leadership of Science and Innovations. All rich and knowlegeable groups will be concentrated in US for world leadership. Moreover, those international students will buy houses, cars, computers and set up their own business for daily living and these will indirectly uplift the retail buying power and consequently uplift the US economy. In addition, more relatives or friends from those international students will be indirectly invited as visitors to US and these will increase the profits of the retail business, hotel reservations, restaurant business and airline tickets reservation. Also, those students established the companies to US will hire 1-5 persons and these will create job opportunities in US. All those inflow of money will bring tremendous monetary income to US economy.

You can either take a leave of absence for a month or 2 (not more than that) If there's a query during H1 extension , you can let them know that you had taken a leave. Draft a leave letter and mail it to the employer so that he has it in records.
But if you use your EAD it doesnt matter. You dont have to worry about the 3months.

The easiest solution would be going to MataMoros, Mexico for stamping. This is the best option for us. Easy, affordable, and takes only 1 day. India, you need to answer several questions, interview to be attended, and ofcourse, they treat everybody as though the person requesting for visa is a criminal.

�Has Anyone Ever Filed an Immigrant Visa Petition on Your Behalf?� but it didn�t ask me this. My I-140 is approved and I am in 7th year of H1B so was going to answer �Yes� to it.

However, you can hire your own lawyer to help you with your questions and answers(if you hire your own lawyer, you can be comfortable with all advise he gives you, since he would have your best interest in mind as you would be the client). However, to file a petition of H1, your employer should be paying the lawyer(either your lawyer or their lawyer).
Filing for H1B petition requires a fixed set of documents and its simple to do if you have time to do a little research. Many employees help their employers and together, they do it themselves without the help of lawyer, therby saving money. An average lawyer would charge 1000 dollars in fees for filing the petition. I think the ability to get an emergency 90 day EAD at the local field offices if they delayed more than 90 days is still there as it is there on the USCIS web page. No???
No. There is no more equipment to produce EAD at local centers. All they do - send a request to USCIS office to expedite EAD adjudication.
