    This was the first time I called up the USCIS help desk (1-800-375-5283) to find about AC21 180 days rule, when she asked what is this for I informed for change of employer.
    I would like to know if that statement would be noted and would it create me any problems in future, as of now I don�t have any plans to change employer.
    Any suggestions are greatly appreciated.

    My Case Details:
    PD: EB2- 2006.
    I-140 Cleared.
    EAD: Received.
    FP: Completed

    Nikon was most popular among the pros photographers during the 1970s and that finding has led me to choose it for my 35mm equipment.

    One of the major advantage is its system ability to use old lenses for its newer bodies. Moreover accessories for the camera bodies are easily available in the local photo retail outlets.

    The lesson learned from the D2h could have gone into the making of the D70 along side with their surprise attempt in the huge advertising spending (TV and other various media) in launching the product.

    Perhaps it could have been a shortsighted affair to aim the D2h only for the PJs. Nikon could have been holding the flag up when the camera could be in the hands of millions of advanced serious amateurs including the many part-time professional photographers world-wide. Not to say the huge market in China could have been overlooked by their thinking engineers!

    What about the millions of part-time and full time photographers doing weddings and other assignments who would wish that the D2h is an 8 MPs. where large enlargements are required.

    The D70 has brought many loyal consumers to stop discarding the old Nikon lenses. In fact their current aggressive marketing attitude has seemingly brought a smile back to many previous happy Nikon users.

    My next wish is for Nikon to design and produce another DSLR by carefully listening to users of their equipment. Not to say that just by assumming that all PJs only need is 4 MPs is wrong because that can be a decoy in their planning too. More to watch from the factory that was set up to produce the D70 in Thailand! I am sure Nikon will not disappoint DSLR users with many more surprises in the very future.

    It is perfectly legal to let two employers file for her H-1B visa. She can even work for both of them!

    Hi,

    A friend of mine who's in India right now has been offered a job by two different employers here in the US. Both of those employers want to file for her H1B.
    From her perspective it makes sense to let both the employers apply for her H1 coz that increases her chances of getting at least one approved. However, reading a bunch of FAQs online it seems that it'd be illegal for her to let both the employers apply for her H1B.
    Is that correct? Does anyone have any insights?

    The H-2B non-agricultural temporary worker program allows U.S. employers to bring foreign nationals to the United States to fill temporary non-agricultural jobs. As of 07/16/10, USCIS receipted 30,154 petitions, toward the 47,000 beneficiaries target for the second half of the fiscal year. This count includes 28,539 approved and 1,615 pending petitions.

    There is a statutory numerical limit, or �cap,� on the total number aliens who may be issued a visa or otherwise provided H-2B status (including through a change of status) during a fiscal year. Currently, the H-2B cap set by Congress is 66,000 per fiscal year, with 33,000 to be allocated for employment beginning in the 1st half of the fiscal year (October 1 - March 31) and 33,000 to be allocated for employment beginning in the 2nd half of the fiscal year (April 1 - September 30). Any unused numbers from the first half of the fiscal year will be made available for use by employers seeking to hire H-2B workers during the second half of the fiscal year. There is no �carry over� of unused H-2B numbers from one fiscal year to the next.

    The H2B visa is available to employers of foreign workers not working in the agricultural field. This visa is only available for work that is temporary in nature. For H2B purposes, that means:
    * Recurring seasonal need;
    * Intermittent need;
    * Peak-load need; and
    * One time occurrence.

    The employer must also prove that there are no unemployed US workers willing or able to do the work. This is established through the state's employment agency using a labor certification process. This process requires a recruitment campaign, including advertising in a local newspaper for available temporary workers. The duration of the visa is limited to the employer's need for the temporary workers. The maximum authorized period is one year. However, the employer may extend the duration of the visa up to three years -- but with a very close watch from the immigration authorities.

    My friend came to US on January through one bodyshopper on H1B visa and he was on project for 4 months.When his project is over and he is on bench then his employer forcing him to send him a email stating that he will be on leave without pay and immediately his employer stopped paying him salary from the day he was on bench.
    Can any one please guide me that how to file complaint to DOL against his body shopper.
    Also i wanted to know that will DOL take any against his body shopper and what information DOL will ask as currently my friend does not wanted to confront with his employer.

    There was a soft LUD on my I-485 on 01/01 and today (01/02). I had applied for my H1 extension sometime back.Will my 485 be touched because of H1 ? My PD is Aug 2006 EB2(obviously cant expect AOS getting processed at this time).

    Any thoughts?

    I totally agree with black_log. Involving Indian firm or trying to use Indian political influence can cause sever damage to our cause. Its not just applies India abut any nation other than US. Unfortunately this is not the first thread of its kind.
    Instead of having TCS, Infosys or Wipro trying to put influence why cant we have companies like Google, Intel, Micrsoft, Cisco or Yahoo. Their voices will be heard with respect.

    Please..request that only those with personal experience with this respond. I have to decide in the next hour or so and have lawyer opinions already.

    Has anyone gone through this?

    My H1 is pending 221g admin process (Pink. possibly because I have a Phd in biology) I can't wait much longer as I may risk losing my job. Can I travel on my valid AP? I am not concerned about keeping my H1 status etc. My only concern is at port of entry. Lawyers have told me it is ok, but I would like to hear from people who have done this themselves.

    Hi,

    Can anyone tell me if its ok to mail my EAD & AP and spouse's EAD & AP renewals to be mailed in the same package to Texas? I can't find any posts regarding this.

    The PO Box address for EAD is different from AP. But i think for non USPS carriers, there is only one address for Texas center (4141 N augustine rd).

    So If I use this address can I mail all the 4 applications in the same package?
    I am not trying to save money but feel that keeping all the apps together might help especially primary and secondary applicants...

    My lawyer said we can use the same non PO Box address mentioned in the EAD to send the AP documents as well. According to the lawyer you can send it all in one big envelope and demarcate the I-131 vs the I-765 or do it like I am, in 2 seperate smaller envelopes and then I am going to put the 2 envelopes in the same fedex package and mail it out.

    I was little worried about filing AC21 when I am just 4 months away from GC. Filing AC21 with my current situation would not bother my GC then I am very much happy to switch over...Thanks everyone.

    1. Did you also enter on H1b and then switched using EAD?

    ---When i filed the EAD renewal i was still on H1B. Just filed EAD as a backup.

    2. So do you have H1B on 'Last entry status' and 'AOS pending' on 'Current status' questions?

    ---Yes. I have I-485 Pending on Current Status
